RoS director-general and home minister appeal High Court stay on PN deregistration. Latest updates on Perikatan Nasional judicial review case and legal proceedings.

The Registrar of Societies (RoS) and the home minister have filed an appeal against a High Court decision that temporarily halted the deregistration of Perikatan Nasional (PN). The appeal was confirmed by PN lawyer Rafique Rashid Ali.

A notice of appeal sighted by FMT names RoS director-general Zulfikar Ahmad and Home Minister Saifuddin Nasution Ismail as the appellants. The notice, filed by a senior federal counsel on their behalf, states that both are dissatisfied with the ruling delivered by Justice Azizan Arshad.

The High Court stay remains in force pending the outcome of PN’s judicial review application.

Judge Cited PN’s Political Role in Granting Stay

In granting the stay, Justice Azizan ruled that exceptional circumstances justified the decision, citing PN’s political role and the implications for its rights as elected representatives and state governments.

Background to the Judicial Review

On 5 October, PN filed a judicial review application against the RoS seeking, among other things, a certiorari order to quash a 23 September notice that had suspended the coalition’s activities indefinitely. The application also sought to nullify a 22 September show-cause notice requiring PN to explain why it should not be deregistered, as well as a declaration that both notices were null and void.

The judicial review application was filed by the secretaries-general of five PN component parties, excluding Bersatu.
