JOHOR BARU The Magistrate’s Court has discharged a senior citizen accused of slapping a man for eating publicly during Ramadan, though he has not been acquitted of the charge.
Abdul Razak Ismail, 65, was granted a discharge not amounting to an acquittal (DNAA) after Deputy Public Prosecutor Nur Fatihah Mohd Nizam informed the court of the Attorney General’s Chambers (AGC) directive to refer the case back to them.
The court was in the process of determining bail for Abdul Razak when the AGC issued its decision.
Conflicting Statements Lead to Rejected Plea
Earlier, the accused had entered a guilty plea to a charge under Section 323 of the Penal Code for voluntarily causing hurt but later contested the facts presented by the prosecution.
The alleged incident occurred on Sunday (March 16) at a shopping mall’s convenience store, where he was accused of striking a 21-year-old man’s face.
Despite the prosecution stating that the victim sustained bruises verified by medical personnel, Abdul Razak claimed he did not strike the victim forcefully enough to leave marks.

Police Continue Investigation Amid Viral Video
Magistrate Shaarmini rejected his guilty plea due to his conflicting statements. However, just as bail conditions were being discussed, the AGC intervened, leading to the DNAA ruling.
The case gained attention after two videos, each under a minute long, surfaced online. Johor Baru North police confirmed receiving a report from the victim and are investigating under Section 323 of the Penal Code.
